1. Acceptance of Terms

By accessing and using the services provided by NearAutoBody.com ("we," "us," or "our"), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use our services.

2. Services Provided

NearAutoBody.com provides auto body repair services including but not limited to:

  • Collision repair and restoration
  • Paint and refinishing services
  • Dent and scratch removal
  • Frame straightening and structural repairs
  • 24/7 emergency towing services
  • Insurance claim assistance

All services are subject to availability and our standard business practices.

3. Estimates and Pricing

We provide free estimates for repair work. All estimates are preliminary and subject to change based on the discovery of additional damage during the repair process. Any changes to the original estimate will be communicated to you for approval before proceeding.

Pricing is based on labor, parts, and materials required for the repair. Payment is due upon completion of services unless other arrangements have been made in advance.

4. Payment Terms

Payment is accepted via:

  • Cash
  • Check (with valid ID)
  • Credit and debit cards
  • Direct insurance payment
  • Approved financing options

If using insurance, you are responsible for any deductible or portion not covered by your insurance policy. We reserve the right to hold your vehicle until payment is received in full.

5. Warranty

All repair work performed by NearAutoBody.com is covered by our lifetime warranty on workmanship. This warranty covers defects in our repair work and does not cover:

  • Normal wear and tear
  • Damage from subsequent accidents
  • Damage from improper vehicle maintenance
  • Acts of nature or environmental damage
  • Parts not supplied or installed by us

Parts are covered by manufacturer warranties where applicable. Warranty claims must be reported promptly and the vehicle must be brought to our facility for inspection.

6. Customer Responsibilities

As a customer, you agree to:

  • Provide accurate information about your vehicle and the damage
  • Remove all personal items from the vehicle before service
  • Authorize all repair work in writing
  • Pick up your vehicle within 5 business days of completion notification
  • Pay all charges in full before taking possession of your vehicle

7. Liability Limitations

While we take great care in handling your vehicle, NearAutoBody.com is not responsible for:

  • Loss or damage to personal items left in the vehicle
  • Pre-existing damage not documented on the repair order
  • Mechanical failures unrelated to our repair work
  • Delays caused by parts availability or insurance company processes

Our liability is limited to the cost of repairs or replacement of damaged parts, not to exceed the total amount paid for the service.

8. Towing Services

Our 24/7 emergency towing service operates on a first-come, first-served basis. While we strive for fast response times, we cannot guarantee specific arrival times.

Free Towing for Insurance Claims:

NearAutoBody.com provides free towing services for all insurance claim and accident-related incidents. To qualify for free towing:

  • The towing must be related to an accident or collision covered by your insurance policy
  • You must provide valid insurance information at the time of service
  • The vehicle must be towed to our facility for repair assessment and service
  • We will bill your insurance company directly for the towing service

Non-Insurance Towing:

If your towing service is not related to an insurance claim or accident, standard towing rates will apply. This includes but is not limited to:

  • Mechanical breakdowns not covered by insurance
  • Voluntary towing for maintenance or convenience
  • Towing to locations other than our facility
  • Towing without valid insurance coverage

Standard towing rates will be quoted at the time of service and payment is due immediately unless arrangements have been made with your roadside assistance provider. Please contact us for current rate information.

We are not liable for pre-existing damage to vehicles being towed or for delays caused by weather, traffic, or other circumstances beyond our control.

9. Storage Fees

Vehicles not picked up within 5 business days of completion notification may be subject to daily storage fees. After 30 days, unclaimed vehicles may be subject to lien procedures in accordance with state law.

10. Dispute Resolution

Any disputes arising from our services will first be addressed through good faith negotiation. If a resolution cannot be reached, disputes will be settled through binding arbitration in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any changes.
